SEXUAL HARSSMENT OF WOMEN AT WORKPLACE
INTERIM RELIEF

Q. Whether any recommen-dation can be made for grant of interim relief by the ICC/LCC while holding inquiry?

Ans. During the pendency of the inquiry, on a written request by the aggrieved woman, the ICC/ LCC may recommend the following to the employer.

• Transfer the aggrieved woman or the respondent to any other workplace; or

• Grant leave to the aggrieved woman upto a period of 3 months. The leave so granted in addition to the leave that she is otherwise entitled; or

• Restrain the respondent from reporting on the work performance of the aggrieved woman or writing her confidential report, and assign the same to another officer;

• Restrain the respondent in case of an educational institution from supervising any academic activity of the aggrieved woman.

The employer shall implement the recommendations made by the ICC/LCC and send the report of such implementation to ICC/ LCC.
