Principle: Part performance of contract is subject to the part consideration.

Factual Situation: A agreed with Delhi Cultural Society to sing in their society for a period of 10 days. The society agreed to pay ` 1000 per day. A performed for 5 days. Thereafter, he went to Noida for some other programme without informing Delhi Cultural Society. Therefore the society cancelled A's programme for the remaining days. A claimed his remuneration for the 5 days during which time he sang for the society. The society did not pay; instead it claimed damages from A for the cancellation of programme.

Decision:

(a) A shall succeed in getting his 5 days' remuneration and shall not be liable to pay compensation to Delhi Cultural Society
(b) A shall succeed in getting 10 days' remuneration
